1. Acceptance of Terms

By accessing or using The Content Cartel (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all users, including free trial users and paid subscribers.

2. Description of Service

The Content Cartel is an AI-powered social media content generation tool. It uses artificial intelligence to generate platform-specific content based on information you provide about your brand. The Service is provided on a subscription basis with multiple plan tiers.

3. Eligibility

You must be at least 18 years old and have the legal authority to enter into these terms to use the Service. By using the Service, you represent that you meet these requirements.

4. Subscriptions and Billing

  • Subscriptions are billed monthly and renew automatically until cancelled.
  • You can cancel at any time through the billing portal. Cancellation takes effect at the end of the current billing period.
  • No refunds are issued for partial months or unused periods unless required by applicable law.
  • We reserve the right to change pricing with 30 days' notice. Continued use after a price change constitutes acceptance.
  • Payment is processed by Stripe. By subscribing, you agree to Stripe's terms of service.
  • Free trials are limited to one per user and expire automatically. No payment is required to start a trial.

5. Acceptable Use

You agree not to use the Service to:

  • Generate content that violates the terms of service of any social media platform.
  • Create spam, misleading advertising, or content designed to deceive users.
  • Produce content that is defamatory, harassing, threatening, or illegal.
  • Infringe on the intellectual property rights of others.
  • Attempt to reverse engineer, scrape, or abuse the Service's infrastructure.
  • Share your account credentials with unauthorized third parties.

6. Content Ownership and Responsibility

You retain full ownership of the content you generate using the Service. We claim no intellectual property rights over your generated content.

However, you are solely responsible for reviewing, verifying, and approving all AI-generated content before publishing it. Always verify that generated content complies with:

  • The current terms and community guidelines of each social media platform.
  • Applicable advertising, FTC disclosure, and consumer protection regulations.
  • Industry-specific regulations (e.g., health claims, financial advice disclaimers).

The Service provides compliance notes as guidance only — these do not constitute legal advice.

7. AI-Generated Content Disclaimer

Content generated by the Service is produced by artificial intelligence and may contain inaccuracies, omissions, or content that requires editing before use. We make no guarantees about the accuracy, completeness, or suitability of generated content for your specific business needs.

8. Intellectual Property

The Content Cartel brand, platform design, and proprietary technology are owned by EZ Marketing 365. Nothing in these terms grants you rights to use our trademarks, logos, or proprietary content outside of normal use of the Service.

9. Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these terms, engage in abusive behavior, or if your account remains in an unpaid state. Upon termination, your access to the Service will cease immediately.

10. Limitation of Liability

To the fullest extent permitted by law, The Content Cartel and EZ Marketing 365 are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to lost revenue, platform bans, or reputational damage resulting from AI-generated content.

Our total liability to you for any claims arising from the Service shall not exceed the amount you paid us in the 3 months prior to the claim.

11. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that generated content will meet your specific requirements or result in any particular business outcome.

12. Changes to Terms

We may update these Terms of Service at any time. Material changes will be communicated via email or a notice on the platform. Continued use of the Service after changes constitutes acceptance of the updated terms.

13. Governing Law

These terms are governed by the laws of the United States. Any disputes arising from these terms or your use of the Service shall be resolved through binding arbitration, except where prohibited by law.
